Best Metal Gutter and Sheet Metal

1. Acceptance of Terms
By accessing our website, requesting services, or engaging Best Metal Gutter and Sheet Metal ("Company," "we," "us," or "our") for any work, you agree to be bound by these Terms and Conditions. If you do not agree, do not use our services.
2. Services
We provide gutter installation, repair, maintenance, and sheet metal fabrication services. All services are subject to availability and performed at our sole discretion. Service descriptions are approximate and may vary based on site conditions.
3. Estimates and Pricing
All estimates are valid for 30 days unless otherwise stated. Final pricing may vary based on actual job conditions, material costs, or unforeseen circumstances discovered during work. Additional work beyond the original scope requires written authorization and may incur additional charges.
4. Payment Terms
Payment is due upon completion unless otherwise agreed in writing. We reserve the right to require deposits for larger projects. Late payments may incur interest at 1.5% per month. Customer is responsible for all collection costs, including attorney fees.
5. Warranty
We warrant our workmanship for a period specified in your service agreement. This warranty does not cover damage caused by acts of God, improper maintenance, third-party modifications, or normal wear and tear. Material warranties are provided by manufacturers and are separate from our workmanship warranty.
6. Limitation of Liability
To the maximum extent permitted by law, Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.
7. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its owners, employees, and contractors from any claims, damages, losses, or expenses arising from your use of our services, your breach of these Terms, or your violation of any law or third-party rights.
8. Property Access and Conditions
Customer grants Company access to the property for performing services. Customer warrants they have authority to authorize work on the property. Customer is responsible for disclosing any known hazards, utilities, or conditions that may affect work. We are not liable for pre-existing conditions or damage to concealed items.
9. Cancellation
Cancellations must be made at least 48 hours before scheduled work. Cancellations with less notice may incur a fee. Once work has commenced, customer is responsible for all labor and materials used.
10. Dispute Resolution
Any disputes shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to recover reasonable attorney fees.
11. Governing Law
These Terms shall be governed by the laws of the state in which services are performed, without regard to conflict of law principles.
12. Modifications
We reserve the right to modify these Terms at any time. Changes are effective upon posting to our website. Continued use of services after changes constitutes acceptance.
13. Severability
If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms, along with any written service agreements, constitute the entire agreement between you and the Company regarding our services.
